Not sure what it's like in the US, but in Canada you cannot prevent someone from making a living. If a trainer was a trainer before working at your CrossFit gym and then decides to leave to teach at a different gym or open their own, the non-compete will not hold up in court.

It depends on the state. California completely prohibits non-competes and crosses them out. Most states will allow one, but only if it's reasonable in terms of scope (geographic area, length of time, type of business).

That's really smart, using a "template" that does not take into account that employment laws vary from state to state.

You should really consult an attorney who has experience drafting such contracts in your state, rather than rely upon what someone on the Internet tells you or gives you.

David, spend some time on here, and you'll find if you've got some common sense there is alot of great information on these boards.

Here's a great idea! How about ask around, get a few "templates" contact an attorney in said state, and ask him/her to review it if any changes are needed. WOW! Brilliant!

Just a shot in the dark here, but I've got you pegged as an attorney?
