Crossfit Music copyright

Can anyone inform me as to the legality of including copyrighted music in workout videos (like most of the videos on Crossfit). I am starting to create videos for an affiliate and was wondering if I'll need to license music everytime I include it in the video. Even better, is there a place where I can find workout appropriate music that is not copyrighted? Thanks.

Does Crossfit.com get the license for every song they include in a video on their site? Mainly, I don't want to risk getting sued.

I'm not sure if they do or don't. The fact is is that you would have to cause some serious attention to your videos for anyone to really notice. When would you honestly expect a band like Linkin Park or Jay-Z to come across your affiliate site, see your video and then sue you. Look at youtube, there are millions of videos that probably could get sued by musicians, but does it happen no. The resources to sue millions and millions of people for taking their song is unlikely and improbable. The further probability of some famous musician coming across your affiliate site and watching your video is further unlikely. This is my personal opinion but just do it anyways. If you still feel unsafe about it then don't use the music or see if you can use the music by asking permission for it.

Well, I can see your problem. You never know what the music studio people are going to say about this kind of thing. Sometimes nothing (your playing the song might even boost their sales), and sometimes they decide they want to sue.

I suspect there might be less trouble if the music is simply being played in the gym at the time of the filming, rather than attaching the music to the video like most main pagers. I'm not sure about this, however, as I'm not a legal expert. A lawyer might know more.

you run the risk of getting your affiliate sued so i would recommend absolutely not using unlicensed music. this isn't for youtube; this is being used for a legitamate business. there are music houses that you can legally license music from for such purposes. one of the biggest is powermusic.com

I don't believe he meant to ask a joke. He has a legitimate concern and rightfully so. Just this year, in March if I'm not mistaken "Prince" and his honchos went after a family when they noticed a song was playing in the "background" of a Youtube video while they were filming their toddler dancing.

Was it audible enough to hear and understand clearly? "NO"

Did this family get money for showing it on the Youtube site? "NO"

So his question should be looked at very carefully, since Lawyers are ready to pounce on anyone when they see an infringement, weather it is legit or not. Money is a non-issue here. Copyright is the key word.

So get someone in the "industry" to clear the air for you. Arm chair lawyers do you no justice and give you no answers.

Wow. I'm just suprised that people actually are concerned about this. The last thing as an affiliate that I'm concerned with is if someone is going to sue me because they hear a song playing in the background of one of my videos. Correct that, I'm not concerned at all, and neither should any of you. You have many other things that should take priority in your life.
