Claiming to be a CrossFit box but not affiated.
 
Hi, I was wondering what the punishment would be if someone were to have CrossFit in their name and offer CrossFit classes, as well as using the CrossFit Logos without being affiliated? I know you are not allowed to do that and if someone were to, what would the punishment be if the box were to be turned in? I have tried to find this out and cannot seem to find the consequences of doing so. Thanks!

Getting sued for trademark violations would be the most likely outcome.

Big trouble. CF is pretty aggressive about this, as well they should be.

They even have an online form set up specifically for reporting violations/concerns.

Crossfit is big business now, and you can be darned sure that HQ will protect its mark.

Thanks guys! I totally agree, especially if you are affiliated and did everything right and someone else wants to cut corners and use CrossFit for their benefit without paying the fees. I appreciate your feedback!

If I started selling homemade shoes, called them Air Max, put a swoosh on the side, and had LeBron James's face on the box, don't you think Nike would come after me?

That wouldn't be much different than the situation you were describing....trademarks and copyrights are trademarks and copyrights, regardless of scale or industry.

First you will receive a Cease and desist letter from CrossFit Inc.

Then you will receive a Cease and desist order from a judge requested by CrossFit Inc.

Last you will get sued for violating a judges Cease and desist order and trademark infractions.

In general judges do not like people who do not follow their orders. You will lose the law suite. Most likely you will owe monetary damages. Most likely punitive damages for ****ing off the judge.

The system works well to punish trademark violators in this country.

Brendan, that's exactly the answer I was looking for. Thank you so much. I obtained my L-1 Cert and they mentioned the legalities of using CrossFit but I didn't want to look like a jerk and say,"well, what happens if you don't?":D So I really appreciate your answer! :thanx:
